This Privacy Policy sets out how FIN LOGIQ AI PTY LTD (ACN 702 557 042) (‘FinLogiq’, ‘we’, ‘us’ or ‘our’) collects, holds, uses and discloses personal information. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1

Introduction

FinLogiq provides an AI-assisted operations platform (the ‘Platform’) to business clients in Australia, including vehicle finance programs, dealer groups, lenders and other organisations. In most cases we handle personal information on behalf of a client, under a written agreement with that client, so that the client can perform its own functions such as assessing an application or servicing a customer. We also collect personal information directly from visitors to our website, prospective clients and business contacts.

We may update this Privacy Policy from time to time by publishing an updated version on finlogiq-ai.com. The current version applies.

2

Personal information we collect

Depending on your relationship with us, the personal information we handle may include:

  • name, contact details and identification information;
  • date of birth, employment, income and other financial information contained in documents submitted to the Platform by a client or its customer;
  • vehicle, transaction and dealer-related information;
  • credit-related information, only where a client is authorised to collect it and provides it to the Platform for processing on the client’s behalf;
  • communications with us, including enquiries and support interactions;
  • device, browser, IP address and usage data collected when you use our website or the Platform.

We do not knowingly collect personal information from individuals under 18 except where it is contained in documents provided by a client for a lawful purpose.

3

How we collect it

We collect personal information: directly from you when you contact us or use our website; from our clients and their authorised personnel when they submit information to the Platform; from third-party sources our clients are authorised to use, such as identity-verification providers; and automatically through cookies and analytics tools on our digital properties. Where we act on behalf of a client, the client is responsible for ensuring it has the right to provide the information to us.

4

How we use it

We use personal information for the purposes for which it was collected and for related purposes you would reasonably expect, including to:

  • provide, operate, secure and support the Platform for our clients, including extracting information from documents, verifying data, preparing decision briefs for review by the client’s staff, routing work and supporting an assistant used by the client’s staff and customers;
  • respond to enquiries, manage our relationship with clients and prospective clients, and administer our business;
  • monitor, test and improve the Platform, including quality assurance of AI-generated outputs, using de-identified or aggregated data wherever practicable;
  • comply with our legal obligations and assist our clients to comply with theirs, including record-keeping, audit and regulatory requirements;
  • detect, investigate and prevent fraud, misuse and security incidents.

FinLogiq does not make credit decisions, does not provide credit assistance and does not use personal information to score, profile or market to individuals for its own purposes. Decisions that affect an individual are made by our clients and their accountable staff.

5

Use of artificial intelligence

The Platform uses artificial-intelligence models, including models provided by third-party providers under contract, to read and structure documents, cross-check information, prepare summaries and draft recommendations, and answer questions from authorised users. In relation to this use:

Our commitments on AI

  • AI outputs are prepared for review by a person at the client; consequential decisions, including any adverse decision affecting an individual, are made by a person and recorded with a reason;
  • we minimise the personal information sent to AI models and, where the task allows, remove or replace government identifiers and other sensitive identifiers before processing;
  • our contracts with AI providers prohibit the use of your personal information to train or improve their models and require zero data retention on production processing;
  • we monitor the quality and fairness of AI outputs and do not use attributes protected under anti-discrimination law as inputs to eligibility reasoning.

Our AI Policy describes our governance of artificial intelligence in more detail and is available on request.

6

Disclosure

We may disclose personal information to:

  • the client on whose behalf we hold it, and its authorised personnel;
  • service providers who help us operate the Platform, including cloud-hosting, security, analytics and AI-model providers, under contracts that restrict their use of the information to providing the service to us;
  • our professional advisers, auditors and insurers;
  • regulators, courts and law-enforcement agencies where required or authorised by law;
  • a purchaser or successor in connection with a corporate transaction, subject to confidentiality obligations.

We do not sell personal information and we do not disclose it to third parties for their own marketing purposes.

7

Overseas disclosure

Personal information handled by the Platform is stored in Australia. Some processing — in particular the inference performed by AI-model providers — may be performed on infrastructure located outside Australia, including in the United States, under contractual terms that require the provider to protect the information in a manner consistent with the APPs and not to retain or train on it. Where we cannot ensure this, we will not disclose the information overseas without your consent.

8

Credit-related information

FinLogiq is not a credit provider or credit representative. Where a client that is authorised under the Privacy Act to handle credit-related information provides it to the Platform, we handle it solely on that client’s behalf and in accordance with the client’s obligations under Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code. Requests for access to or correction of credit-related information should be directed to the relevant client; we will assist the client to respond.

9

Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, including encryption in transit and at rest, access controls with multi-factor authentication, logging and monitoring, and staff training. We retain personal information only for as long as needed for the purposes for which it was collected, for the period our client instructs, or as required by law, after which it is deleted or de-identified. We assess suspected data breaches under the Notifiable Data Breaches scheme and notify the Office of the Australian Information Commissioner and affected individuals where required.

10

Access, correction and complaints

You may ask us for access to, or correction of, the personal information we hold about you by contacting us using the details below. We may need to verify your identity, and where we hold information on behalf of a client we may refer your request to that client. If you have a complaint about how we have handled your personal information, contact us and we will investigate and respond within 30 days. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (oaic.gov.au).
